HORSE RIDING / INTERACTION IS A HIGH RISK ACTIVITY WHICH CAN BE DANGEROUS & SERIOUS INJURY/DEATH CAN RESULT FROM YOUR PARTICIPATION IN THIS ACTIVITY

YOU ARE FULLY RESPONSIBLE FOR YOUR CHILD AT ALL TIMES

Horse/Pony (hereafter referred to as equines) Riding and interaction with equines carries inherent risks & is a HIGH-RISK ACTIVITY. Equines are unpredictable by nature. When frightened, angry or under stress, an equines natural instincts are to jump forward or sideways, to run away from danger, to kick, bite, buck or rear up. Equines are extremely powerful. If a rider falls to the ground, the fall distance will generally be more than 5 feet and whilst the equine is moving. All equines may react unpredictably on occasion.

By participating in any equine related activity with PONY PURSUITS you are acknowledging that you understand & accept the risks and dangers involved in horse riding / interaction and that your participation in horse riding and related activities may result in damage to personal property, illness, personal injury or death. These risks and dangers may be caused by yourself or those you are accepting responsibility for, the horse/pony or other participants, by accident, or by the forces of nature, or by other causes. These risks and dangers may arise from foreseen or unforeseen circumstances. By participating in a riding session with PONY PURSUITS or allowing my child or person for whom you are responsible for to do so. You  knowingly & voluntarily accept & assume these risks & dangers for yourself or on behalf of the person you are responsible for.

In addition, for those riders choosing to ride “off the Lead rein” the following applies; I have chosen to participate in a horse/pony related activity with Pony Pursuits and have made the decision to ride off the lead rein (without direct supervision) despite the risks of doing so.  I arm therefore responsible for maintaining full control of the horse/pony belonging to Pony Pursuits and am not covered by Pony Pursuits liability insurance which only applies to riders who remain under direct supervision, where the horse/pony I am riding remains on a lead rein, led by a representative of Pony Pursuits. The presence of Pony Pursuits personnel is not a guarantee of safety and does not lessen any risks assumed by choosing to ride off the lead rein.

All participants are advised to wear an approved riding helmet provided by Pony Pursuits to help protect them against head injuries or Provide a helmet meeting safety standards PA015 or VG1

All participants must be in good physical & general health to participate in a ride or related activity and hereby confirm that you have no known          physical disabilities or health problems that may present a risk or danger to myself or others.

Except for Pony Pursuits wanton or wilful negligence, Pony Pursuits are not responsible for bodily injury or property damage that incurred by any participant should sustain while riding / interacting with a horse/pony provided by Pony Pursuits. I am also responsible for any expenses incurred as a result of such bodily injury or property damage. I am responsible for any time I, or my child or legal ward shall lose in employment or school or other activity. I, on my own behalf and on behalf of my personal representatives, executors, administrators, heirs, successors and assigns, hereby release, indemnity and hold harmless Pony Pursuits and their employees or representatives from any and all losses, actions, liabilities, damages, obligations, claims or demands of whatever nature for any injuries, damage, losses, liabilities, costs, expenses, fees, compensation, claims or demands of any kind or nature whatsoever on account of or in any way growing out of, or which in the future may result from, property damage, bodily and personal injury, illness, paralysis and death to you or members of your family including legal wards or children that you are supervising at that time, as a result of or in connection with my participation in a Pleasure ride or related activities

I agree to indemnify & pay any expenses, loss or damage that is incurred by Pony Pursuits and all their employees and representatives and members of the public, arising out of myself/my child/any person under my care, riding or interacting with an equine belonging to Pony Pursuits.

In the knowledge that a parent by law cannot waive the personal injury rights or other claims of a (their) minor child or legal ward, the undersigned parent or guardian of said minor child or legal ward agrees to indemnify Pony Pursuits and all of their employees and representatives from any financial loss suffered as a result of any claim brought on behalf of said minor child or legal ward. Further, I agree not to bring any claim or other legal action against Pony Pursuits and all their employees and representatives for personal injuries suffered by said minor alleging negligent acts or acts of omissions by Pony Pursuits and all their employees and representatives. This Release includes, but is not limited to, all claims or causes of action.

I acknowledge and agree that my participation in a Pleasure ride (whether it be a ride & groom, a hack, a fun session, party and any other activity  with pony pursuits is completely voluntary and I acknowledge, accept & take responsibility for all risks, known and unknown, including, but not necessarily limited to, those risks identified in this release. The invalidity of any provision of this Release shall not affect the validity of the remaining provisions.

PLEASE ENSURE YOU HAVE THOROUGHLY READ, UNDERSTOOD & AGREE* TO THE ENTIRE CONTENTS OF THIS RELEASE FORM.

*HAVING RECEIVED THE ABOVE INFORMATION WITHIN YOUR ECPRO BOOKING CONFIRMATION OR CONFIRMATION TEXT PRIOR TO PARTICIPATING IN ANY ACTIVITY WITH PONY PURSUITS, IT IS FAIRLY ASSUMED THAT BY ATTENDING YOUR BOOKING, YOU UNDERSTAND & ACCEPT THE INHERANT RISKS ASSOCIATED WITH HORSE/PONY RELATED RIDING/INTERACTION.

PONY PURSUITS REDUCE RISK BY;

• USING SAFE & EXPERIENCED EQUINES
• HAVING 1 HANDLER PER RIDDEN PONY FOR CHILDREN
• KEEPING RIDERS ON A LEADREIN UNLESS A DISCLAIMER HAS BEEN SIGNED OR FOR BOOKINGS VIA ECPRO A LINK TO THIS DISCLAIMER IS SENT AUTOMATICALLY WITH YOUR EMAIL BOOKING CONFIRMATION. By attending this booking we can fairly assume that you have read the Horse Riding Disclaimer and accept the risks associated with horse /pony riding & interaction both in terms of personal responsibility and responsibility for any riders whom are under your care or supervision.

• PARENTS/CARERS ARE AWARE OF THE RISKS & PHYSICALLY HOLD CHILDREN UNDER 5/OR CONSIDERED TO NEED ADDITIONAL PHYSICAL SUPPORT DURING THEIR RIDE we will verbally discuss & agree the safest way to proceed on the day

FOR THE SAFEST EXPERIENCE THE PONY PURSUITS PONY HANDLER IS RESPONSIBLE FOR CONTROLLING THE PONY AND PARENTS/GUARDIANS ARE RESPONSIBLE FOR SUPERVISING / SUPPORTING THE RIDER DURING THEIR SESSION
